I sent a load of dosh to a chap from eBay. Watch purchase of course and we agreed to payment via Bank transfer. Paid on Thursday (late) and as of this morning, the money had still not hit this guys account, I was getting rather worried. Much tedious talking with bank people, and it turns out they had stopped payment and frozen my account because of 'unusual activity'. Which is fine... apart from the fact they didn't say a word to me! No e-mail, text, nothing yet they can send me messages by all sorts of methods when they want to try and sell me something!

It has arrived in his account now, but the guy is now away until Thursday so I have missed the window for early delivery. Tad niggled.

I am surprised, banks normally contact you damn quick about such things.

I'd be asking why there was no contact.

Is this the first time you've opted for a direct bank transfer for that sort of sum?

Any absences due to disability may be recorded and counted as part of an absence management process, but should be disregarded for the purposes of considering a warning.

Indeed. A bloke I know had a very interesting redundancy settlement after his company failed to take into account his type 1 diabetes.

Bought 2 things from an eBay seller. Doesn't offer a discount on postage and has the carrier set to RM 1st Signed For.

They came through Hermes.

Greedy fucker.

Aye, fair enough. My manager knows I'm diabetic because I told them myself. They also know I'm on anti-depressants, because I told them. I get on with them well, but it's the people above them / to the side of them who piss me off.

I'm still filling in applications for other jobs, as £22k per annum (after promotion!) is a piss-take for 2nd line IT. Especially in Aberdeen, where everything from restaurants to property is £stupid because OIL.

...going to court for a small claims case.

I had to go in today with a query. I think half the people in there thought I was in for murder the amount of hand wringing nerves I had.

It's been the most stressful and drawn out thing I have had to deal with.

Law. Another career I can rule out: not cut for it.

You should be able to open a case against them for wrong service sent etc

If it helps at all, in my limited experience of small claims court, it's the run-up that's the stressful part.

The actual hearing is quite straight forward and nothing like you imagine it to be - mine was basically the judge and both parties around a table. If you have a clear case, evidence to back it up and can show you've behaved decently, you'll be fine and should win.

Complain to seller, ask for refund of P&P charge. If they won't, then complain to Ebay - you can easily prove that you didn't get the service you paid for. Seller should be able to provide a Royal Mail tracking number, clearly he can't!

I accidentally swallowed a bit of petrol last night when siphoning some out the bike for my camping cooker.

My burps still taste of petrol & my guts feel wrong. Modern petrol is shite, in days of old when 4 star rolled all I got was a dry mouth for a few hours.

IT technicians in my work (education) earn more than that!  Our main technician is a really, really good guy who gets to implement his own initiatives and is paid according to his merits.  I'm about as far from Aberdeen as it's possible to get and not all places are the same but there are plenty of decent IT jobs out there that pay better and don't have the bullshit you're experiencing.

Ta. I'm so confused.

I need to send my documents to them but they have put a different address on their court questionairre to their usual business address, which itself differs from the business address registered at companies house.

Where do i send it?!

I have emailed to ask, but got an "out of office" reply.

Also, do i send it signed for or does that make them not receiving it on time even more likely (they aren't in so the posty takes it back to depot? etc)?

I am tending towards sending it to the address we have used for everything else so far, but really don't know what the best thing to do is.

Personally, I would (and did) send any correspondence to the other party signed for - they can't claim it wasn't received then. If they don't collect from the post depot, that's not your problem - you followed procedure and sent documentation as instructed, which of course you can then prove if requested with the receipt and tracking info.

Address wise. I'd ignore the address on companies house and use whichever address it is the court has registered.

Assuming this is the bathroom saga, remember to document as much of the events prior to starting court action as you can - dates of phone calls (and anything you can remember from them), date and copies letters sent, copies of inspections by a 3rd party, all that sort of thing. Apologies if I'm teaching you to suck eggs, but that sort of thing becomes harder and harder to do as weeks pass, so best doing it sooner rather than later. If you do that and it's all as you described on here, I really can't see how the court will do anything but find in your favour :)

Why is everything you buy in multipacks of such inferior quality to its 'for individual resale' brethren...

Multipack cans of coke - vile

Multipack Walkers Crisps - like chewing nails and broken glass

Multipack Chocolate bars - flippin tiny

I can understand maybe why they give you less, to make it seem like more of a deal, but why is it an actual different and vastly inferior product?  Do they have two different production lines or sommat?

I know, I've had plenty of interviews for them the past couple of years! Just not actually got a job offer yet. Bah! My time will come.

Eyeing up a position at Newcastle University at the moment, should get on and fill that application in.

If you prefer to stay in Scotland there is a Band 5 IT Support at Oban for the NHS currently https://jobs.scot.nhs.uk/_results.aspx?catID=1&regionID=10&orgID=&word=

That's £22,440 - £29,034 with automatic progression up the scale (provided you 'pass' your PDR). Plus with the new NHS pay agreement it'll be over £30k in four years.

I'm considering it myself, but it's a bit too far north for where I want to be.

Thanks, I just like to think the worst and am convinced something will go wrong with it all.

Is this the builder ‘thing’ Louise? Good luck with it, you deserve a result and no mistaking.

Yes it is, thanks. They are now admitting that they have done a rubbish job but are saying the quotes we have are too high and are demanding their right to return and put it right. Obviously we aren't keen on having them back!

It's such a kind of throw-away term "just go to court" but it takes a serious amount of time and effort, I hadn't really realised. Its been a year and a half since they did the work and a year since we asked them to pay to put it right (as they had said that they would no longer do work for us, bar removing a leaky shower screen and the wall it is attached to).

It doesn't help that I am quite a principled person and tend to get really hung up on what is right and wrong, (you may have guessed!), while at the same time my anxiety means I catastrophise, so I am winding myself up into the scenario that the judge will side with them and not only will we have to pay to fix it ourselves but they will think they were right and I know they weren't!

I need to learn to relax!

I have experience of small claims court.

It was me plus the other guy and the judge in his office. the judge had read all the information before hand and kept it very low key. He got us both to say what happened and asked the other person if he wanted to question what was said.

And then decided that on balance I probably wasn't the sort of person to ram someone that was overtaking them where as my photos of the road showed that the other bloke should not have been overtaking me at that particular point in time.

That's the key. On balance not beyond reasonable doubt.

That sounds like quite a story!

You might strike lucky and he doesn’t turn up, which (I think) means you win by default.

Nothing all all wrong with being principled, this island we live on has a distinct shortage of that.

I think I mean I take it to extremes.

You know that saying about rules being for the guidance of the wise and obedience of fools?

I'm that fool!

You're no fool, Lou.  I've known you long enough to know that...   :)

I've been asked to prove that I've a right to work in the UK by work, despite being born in the UK and having lived here the entire time. They have also demanded my birth certificate, which I've not got, I've lost it at some point while I've moved addresses. Are they trying to be awkward or is this a regular practice?

I believe they are legally required to do that these days.
