Baz, 155V6. There is nothing I can add other than to offer my condolences and that I hope with time things will get better.

 

As Trigger says, I dread the day anything happens to either of my parents, can't imagine what you must be going through.

I think it would be respectfull if the petty grumps we all love to post stop on the day this sort of personal bereathments happen to one of our own , I for one will be doing this from now on

Yep... its the all new V5C document that has NO PROVISION FOR SCRAPPING A VEHICLE YOURSELF, you have to take it to a treatment facility and get a certificate of destruction, OR get the treatment facility to sign the doc to say they they have scrapped the car. However, I have already weighed the car in and so, its gone, and I cant get a signature. Looks like i'm going to be SORNing it forever.

 

What the hell was wrong with just ticking a box to say the car has been scrapped??? Oh thats right, the DVLA are useless at everything.

I suppose so but there's every chance they could refuse. The car went in as a ton or so of light iron, and would have soon been baled and shipped out. Nobody will have any memory of it going in!

 

I'll write to the DVLA and tell them its was scrapped prior to the V5C arriving, its going to present a problem in the future for people though. What if you cut a car to pieces and take it to the tip? If they are trying to keep track of all the nasty liquids that can get into places they shouldn't then its worth remembering its not illegal for an individual to take used engine oil to the local recycling centre- hey presto, a de-polluted car!

To cut a long story short, my work are attempting to sack me through a tribunal, largely because they don't understand how Google works.

I'm an IT Consultant however I am on the other side of the Irish Sea. Notwithstanding, is there anything I can do to help?

Re; my problems with ebay buyer who received a working item, which he then broke, claiming he received a broken item - I duly offered a refund but RSOLE wants refund on postage, or (get this) he's too tight to send the aerial back and wanted me to refund all or some of the money so he could buy another one - he left me bad feedback (my first in 6 years) because of this.

Can i have a rant about ebay please.......

 

First of all if your going to bid on a van, dont turn around when you have won it and ask me to deliver it to Birmingham without any mot or insurance, and also for no more money to cover costs (petrol etc)

 

secondly when i say i cant deliver it, dont go in a huff and try to put others off buying it,

 

Thirdly, dont then wait a month and then leave me bad feedback which has left my 100% ratings scarred :(

Same here, I'd never leave bad feedback for anyone if I felt like having a big girly tantrum.

This is all too easy for arseholes on ebay, it's nothing like the real world. I'll never sell anything on that place ever again.

Cheers - I'll be alright, just might need someone to attend in person at some point and explain to a selection of people how the Internet works, possibly later in court too. They've essentially highlighted a list of work websites and concluded that the rest are personal use and I should be sacked. They say I have only spent 2% of my time on work websites and the rest was all personal.

 

On that basis, I've been painstakingly going through a list of Google servers, banner ads, RSS feeds, software updates (from their machines) and even some particularly obvious work-related websites (some of which I was explicitly told to go on by my work) and am soon to present to a tribunal that their figure of 2% work use is actually incorrect and the actual figure is somewhere over 99%.

 

Unfortunately, they were completely unprepared to talk to me about it beforehand and wish for this to go through a formal hearing and suchlike. Wish I was making it up!

I guess it depends what you were asked to do in your job role and your company's policy. If it was web-development/SEO/web promotion related then they'll probably lose providing you can demonstrate what you've been doing in this area.

 

You probably need to talk to the Citizens Advice. In addition I would recommend a solicitor specialising in constructive dismissal cases. I'd offer help as a consultant, but I'm not IT qualified, however I am qualified and published in marketing including e-marketing.

I'm fortunate in that mine (a university) permits pretty much anything. Porn I don't visit anyway at home or work, but I'm online banking, eBay, accessing forums, etc.

 

In my case as a lecturer in marketing everything can be explained as 'academic research' :roll: , even Autoshite :shock:

If you have been working somewhere for less than a year they can just tell you to fuck off and throw you out without any notice... I think. Well it happened to me anyway.

 

Surely if they are following their "rules" they need to give you a verbal warning, then a written one.. or something?

 

At my place of work I dont have my own login, so I normally pinch someone elses. They monitor the sites visited, but they dont know its me! Although the number of employees likely to visit Autoshite, The Maestro forum or Retro rides is somewhat limited...

I guess it depends what you were asked to do in your job role and your company's policy.

Debt recovery involving a large amount of tracing people and obtaining contact numbers, it's a big part of the job and I was particularly good at it.

 

Figures are in by the way, they say my non-work use was 97.7%, I've just done all my adding up now and can confirm that my non-work use comes to..... 0.4%! About 1MB.

You've then got a clear argument about how you're using the web to trace individuals from their online records; Facebook, postings, etc.

 

A good solicitor should be able to demonstrate why this is relevant. As would an expert witness who is involved in debt recovery themselves but not connected to the company. Know anyone else who's in the same business - here or elsewhere?

A decent barrister with experience of this kind of case will wipe the floor with them then turn it around and do them for unfair dismissal.

Cheers fellas! At this stage I'm looking to go legal either way, I've never done a legal case but I reckon in this case I'm completely justified in doing so.

 

The frustrating thing is that I've even tried to tell them and get them to actually look at what they're doing before they all end up in trouble, but none of the staff involved seem to have a clue and have been completely unhelpful throughout. It's ridiculous, all I want is them to say "Actually, this is all wrong, rubbish and we've sat on it for too long anyway" and wipe the slate, but now I'm going to have to attend all sorts of daft meetings and court and all sorts.

 

I'm fed up now anyway, at this stage I might as well. I imagine all the stress and lack of sleep it has caused me so far will be fairly compensated, not sure if the damage to my career will be as I'll always be "that one who turned round and sued us".

Yes, don't throw in the towel or walk away! Your reputation is at stake no matter what from here on in; if you concede, then you've got a black mark on your record and if you pursue it you may run the risk of being branded a troublemaker. But there's an important principle at stake and false accusations need to be quashed. Better to have had the courage to make a stand against unfair accusations than to try and explain in the future why you left a particular job. I reckon most people would admire that fortitute and dedication to purpose - those are qualities employers are always banging on about.

In a private firm then it probably would damage your career, but in the civil service where it's not their money they spend then it probably won't as much.

 

Case in point - woman at my former employer slips on a wet floor and badly breaks her hand. Employer admits liability, knows they were in the wrong and has to pay out (although they are apparently dragging it out as long as possible before they do). Because she chose to sue the operations manager now has a black mark against her and will forever hold it against her. Twunts. But thats the kind of company it is.

 

As far as your case goes Hirst, a specialist in employment law should be able to walk all over them by the sound of it. Still, its not a pleasant thing to go through so I hope it will all be ok.
