Still naughty though innit? One is bad enough, but it looks like he's ripped off a whole 'member's cars' type thread!

when i complained to ebay about a pic of mine being used they said once i post it on tinternet it becomes public domain as there is no copyright :shock:

It's not really the copying of the photo that's naughty, as rightly pointed out it's public domain once you post it on the t'interwebs. If you're that bothered about stuff there's freeware programs to watermark images.

 

The naughty bit is misrepresenting the car for sale.... like an estate agent saying "oh yeah, we couldn't be bothered to drive out to take any pics so here's a picture of another three-bedroom detached place. It's about the same colour...."

Glad that's cleared up - means I can start a new auction site called EBAY2, using all their code and design. After all, it's public domain.

Aaah, you could use their image files.... but the logos are copyrighted, and probably the site design too :) So you'd have to change the images to look different.

 

But, if you were sad enough to save the ebay logo to your hard drive, then you wouldn't get into trouble for it, which is the point of copyright.

Just thought I'd point out that things posted on the internet aren't instantly in the public domain. Copyright remains with the creator unless you've agreed somewhere to transfer it. You have to be contactable and there has to be a way to trace the image back to you, which there would be in an ebay listing.

 

The bodged-up digital economy act muddies the water a bit by giving orphaned images to whoever wants to use them and the validity of this hasn't been tested yet as far as I know.

 

If you chuck your own images onto an anonymous image sharing site (not flickr, something like tinypic) then yes, you are putting it in the public domain and you really don't have any legal rights regarding it.

Sorry but my website says copyright A to E Commercials, and if you take the 'public domain' argument literally, you can pull in images in magazines and TV. Copyright rests with the person who took the image, jointly with the person/vehicle/property if it's not signed over. I know background artists who have stopped transmission of a TV programme cos they were not paid and therefore the release they signed becomes null and void..

But how do you prove you took a photo? You've got a copy, I've got a copy.... very difficult. Strip the EXIF data out and you've got a 'fresh' version with nothing to tie it to the original, maybe crop it and process it a bit....

 

Not really as straightforward as downloading NOW 78 off piratebay, anyhow.

I've had this argument with Flikr, an edited version of a photo with no registration numbers appeared on a competitor's photo album. I had the original showing the reg numbers. They took off the copy. That was good enough for Flikr.....

I don't think the ad is a fraud, surely it's just a case of the seller getting carried away with nicking images of a similar car.

Ahem...it actually says it is a fraud on the C&C listing (hence the quote).

That's been on Ebay several times, through the hands of at least one dealer and has been steadily moving further North each time it sold (started down here in Benfleet I think)

Shame it's ended up with a 20 stone fat bastard who's pretty much holding his hand up to wrecking the drivers seat.

 

Sorry, but that's a crime. Someone keeps a car pretty much mint for 20 odd years and then some fat sod has it for six months and uses the drivers seat as a landing pad.

This maestro seems to be owned by a fruitcake. I say that because of the rambling, inane description, and the fact that he already listed it once, and randomly adjusted the price up and down raymanboy-style on a daily basis. Of course, it didnt get a single bid. Now he has relisted it and today has bumped the price up to a new high (£50 more than its previous record).

We had a Sierra based Marlin kit car in work a while ago and you couldn't help thinking someone should have talked the old boy out of it. He could have had a nice MX5 for the money he'd punted on that thing and would have a nice, open top car straight away. Rather than a dodgy POS after several years of work....
