I had the fuzz at the door as an sd1 I sold had been siezed due to a drive off in blackpool, I expaned I had received most of the money for the car and the pc told me to come and collect it before the weekend, so I did complete with paperwork. Not bad a free car from the police.

Top advice, I don't know the full story with what's happened to the previous owner. Apparently the landlord has contacted him and tried to get him to move it but nothing has happened. I'm not planning to do anything with it apart from moving it. If the owner of the car wants to pay me for *storage costs then I'd be happy to give the car back.

It is the moving it along with an intention to permanently deprive the owner (and I've seen poorer inferences of that than a statement that "I've just scored a free car!") that constitutes the theft. It'll be you, not the landlord that gets the Poice chapping on their door.

 

The owner will be obliged to give you nothing. He has no contractual or other relationship with you. You have his property and you'll be obliged to give him his car back. Full stop.

 

Get the landlord to provide you with evidence that they've contacted the owner and told him to pay up or the car will be sold to cover the costs. Theoretically he needs a court order even then, but in practice, failure to respond will do.

 

It is definitely worth waiting to get this done before moving the car. If you want to text or email me, I can give you specimen wording to use in the letter that the landlord sends.

 

In 2007, this was still an older "enthusiast" type car. Not the standard banger. It might even be someone who reads Internet forums who owns it. Be careful, Scott, you are potentially opening yourself up to a load of grief.

I'm not intending to deprive anyone, it's going to cost me £30 to move it so if it all goes to shit it's not the end of the world. The thing is, the landlord wants it gone this weekend, We either move it or it gets scrapped. My pal who is renting a house from the landlord is going halfs on the car so he can get half of the shit too.

By storage costs* I meant £30, if he doesn't pay then it's not the end of the world, who knows maybe the owner is dead? I'll not do anything until I have the full details.

I've been on both sides, several times. For you, it's a potential minefield.

 

If the Landlord can't demonstrate ' ownership', either via the Court, or possibly repeated attempts ( provable) at unsuccessful contact, they can't pass title to you. Whatever they say. They can even write you a receipt, which may well be worthless to the Rozzers..

 

We aren't saying don't do it. We are saying to trace the owner, to at least to demonstrate "best intent". Pay them £1, so Contract has been established.

A trip to the Police Station to trace the owner will help( they won't do anything, other than check it isn't knicked) but do get it logged/ get a reference. It may well stop the Police charging you, if the Owner suddenly pops up..

 

If it's lovely, and once it's legal, buy a cheap cherished plate. Change the reg!

 

In the event you get it on the road, unintentionally/ unknowingly driving it past the legal owner could just create rage/ action/ nastiness.

I think if the owner turns up youve just done them a favour if the landlord intended scrapping the car after the weekend.

We've saved it from being scrapped but we'll need to get to the bottom of everything before doing anything else with it.

Probably not, there's some frilly bits and dents but it seems OK. I'll maybe see about taking it along to the unit, see how it goes then make a decision as whether to keep it or not.
