I wanted to do a collection of new tat but...............

It would just be a picture of my drive and the first 1/2 mile of road, Thanks to a nice young lady my momo is now looking like this.

I happened on my way to work on my sons birthday, he was a passenger and its the first time hes ever been in a slight bump, he was not a happy bunney, I was proceding down the road when this 'delightful' young lady decided to cross my path into a side road however her car now looks like this....

Anyway cutting a very long story short, the said young lady had informed her insurance company that I had swerved to avoid a car coming out of the side road hence forcing me to swerve into her, she now has severe whiplash and my insurance has written off my car and offered me the grand sum of £450, only problem is £350 is excess which I hope justice will prevail and I will get it back.

So being mega skint at the moment I have been looking for cars around the £500 mark, believe me there are some piles of cack out there, after traveling miles and being disapointed over some overpriced wrecks I stumbled across this....

Its on a Y plate with 75k miles, 1.6 petrol and done only 10 miles in 2 years as it was a second car and those 10 miles are for the last 2 years mot.

 

Its got those super squidgy french seats that the wifes old Clio had along with a superb heater, my Xsara had a poo heater that would only blow on full power, but the car was super reliable and never once let me down in the 6 years I had it so I am sad to loose the old gal.

 

Anyway, anything I need to know about these French lovlies? the cam belts been done recently and the sun roof does not leak which is unheard of on the Clio, can't find any rust as yet but not keen on the fitted sterio but will have to live with it as its got the display higher up the dash, needless to say I have transfered my seat covers over as they are a great conversation piece. I have been sat at the lights and had youfs come over and say they are cool, imagine that cool at 50!!

 

Any helpful tips are greatfully recieved and maybe one day I can do a tat collection.

Pray that they changed the waterpump with the belt,  carry a spare coil pack and the torx fitting to fit it and keep the rear arches clean to avoid grot.

 

Hope the insurance bods side with you,  I decided after a few that insurance claims weren't worth the stress so tend to view my fully comp policies as third party and just bodge things back together before the assessors have a chance to look at them.  This seems to have had a karma effect of cheap insurance.

Hopefully the insurance company will side with you rather than taking that daft bint's view of events.

And right there is another reason to get a dashcam. 

I have been there myself with people who refuse to admit their fault and turn into devious lying bastards for the sake of their policy excess and the sniff of potential compo payouts.

 

There was a thread on here a while back by dollywobbler I think, recommending a cam from china - I recently bought one....took a while to arrive mind....and the image quality is frankly astounding for 40 quid or so.

Thank you every one for the kind words, not bad for £450, its down to playing the waiting game, you always see plenty of decent tat when your not in the market and skint. Yes the water pump was changed too so I am informed, no paper work to prove though, the guy seemed nice enough so no reason to doubt but I am too trusting. Can't wait untill May 1st so I can tax it and drive the bugger.

It's times like this you realise that there really are some shite, morally bankrupt people out there.

 

The car looks like a good un - usually electrical gremlins and rot at the rear that sees these off.

I would stick it to her. Argue the blame until you are blue in the face, you have nothing to lose as you are going to get sod all anyhow.

 

Re the Megane I would steer clear as its blatantly not been used with just 10m in 2 years. When you start driving it again everything will break.

Without a witness she can say what she likes, doesn't mean it'll be believed. Are you not going to contest her version of events?

Unfortunately too many of  these twunts  regard a collision as a lottery win.   Poke it up her big time.    Hope you get back on the road  soon

Update, advice required, I have just come home to a letter saying 'Notice of tranfer of procedings' Miss ??,,<<.> as claimant and me as a defendant, does this mean I am being sued through the small claims court for the above collision? because if so the outcome has not been decided by the insurance companies yet.

One of her witnesses has disappeared off the face of the earth and the other ones statement is so wrong that when my insurance read it out to me I could not believe they were taking im seriously. He said the blue car hit the red car, I was in the red car she was in the blue and he was her witness.

 

My insurance company came to interview my son who was in my car at the time yesterday to use him as a witness in court which is most unusual.even they said so, but this is just getting out of hand, Anyway can she sue me if its not been settled yet? only SAMBO is doing her fruit. also am I right in thinking that the car insurance should still sort this out.

Give the insurance your side of the story (I.e. The truth) and don't back down.

 

It will be mega stressful until it's sorted, I've been there but as much as you want to just take the easy option, if you are in the right just stand your ground.

 

Assuming you had right of way how can she possibly argue otherwise? Is she trying to say she wasn't intending to turn down the side street?

They all do that sir.......................she has told her insurance that I swerved to avoid a car pulling out of the side road thus hitting her car, I have been fighting this since March 12 and I am starting to lose money as well as my insurance policy went up tho I did get it even cheaper using the Merecats and my wifes car policy went up even though I had to be taken off just to save her money, it cost me money to be removed.

I am usually a push over but I am adamant that a young whipper snapper ain't gonna get a whip lash claim or two outa me, My insurance said they have put aside 11k incase it goes in her favor, no wonder me laddo and others pay £stupid for insurance

I'm sure you already do, but keep records of everything this has cost you, especially the insurance situation with the other cars.  Also, keep copies of everything you pass to your insurance, and request copies of everything they receive from the other party.  Did you take any other pics of the crash scene, such as showing the positions of the cars on the road?

Sounds like the silly cow has seen all those daytime adverts about whiplash, no doubt in the ad breaks on Jeremy Kyle and those stupid loose bitches.

 

Stick to the truth BD, from what I have read there is absolutely no evidence of a car pulling out causing you to swerve, only evidence that she drove into your path. The witness may have disappeared but they still said at the time that 'She drove into you'

 

I don't even know you but I am slightly wound up now, I really hope she gets piss all out of this.

Had a similar situation last year -woman bit me and it was her fault but as she lied that it was my fault and there were no witnesses it eventually went 50/50. That's how yours will probably end up.

 

Pass the letter to your insurer, with no witness she can say what she likes but unless you back down she won't get anywhere.

 

So tell your insurer your version of events and insist they do not accept liability. It's in threir interest for it not to be your fault. It's a pain in the arse but persevere with it and don't back down.

Had a similar situation last year -woman bit me and it was her fault.

You're meant to stick something in their mouth so they can't bite you. A tennis ball, or an oily rag or something.
