I guess it depends what you were asked to do in your job role and your company's policy.

Debt recovery involving a large amount of tracing people and obtaining contact numbers, it's a big part of the job and I was particularly good at it.

 

Figures are in by the way, they say my non-work use was 97.7%, I've just done all my adding up now and can confirm that my non-work use comes to..... 0.4%! About 1MB.

You've then got a clear argument about how you're using the web to trace individuals from their online records; Facebook, postings, etc.

 

A good solicitor should be able to demonstrate why this is relevant. As would an expert witness who is involved in debt recovery themselves but not connected to the company. Know anyone else who's in the same business - here or elsewhere?

A decent barrister with experience of this kind of case will wipe the floor with them then turn it around and do them for unfair dismissal.

Cheers fellas! At this stage I'm looking to go legal either way, I've never done a legal case but I reckon in this case I'm completely justified in doing so.

 

The frustrating thing is that I've even tried to tell them and get them to actually look at what they're doing before they all end up in trouble, but none of the staff involved seem to have a clue and have been completely unhelpful throughout. It's ridiculous, all I want is them to say "Actually, this is all wrong, rubbish and we've sat on it for too long anyway" and wipe the slate, but now I'm going to have to attend all sorts of daft meetings and court and all sorts.

 

I'm fed up now anyway, at this stage I might as well. I imagine all the stress and lack of sleep it has caused me so far will be fairly compensated, not sure if the damage to my career will be as I'll always be "that one who turned round and sued us".

Yes, don't throw in the towel or walk away! Your reputation is at stake no matter what from here on in; if you concede, then you've got a black mark on your record and if you pursue it you may run the risk of being branded a troublemaker. But there's an important principle at stake and false accusations need to be quashed. Better to have had the courage to make a stand against unfair accusations than to try and explain in the future why you left a particular job. I reckon most people would admire that fortitute and dedication to purpose - those are qualities employers are always banging on about.

 

Good luck and get some professional advice.

In a private firm then it probably would damage your career, but in the civil service where it's not their money they spend then it probably won't as much.

 

Case in point - woman at my former employer slips on a wet floor and badly breaks her hand. Employer admits liability, knows they were in the wrong and has to pay out (although they are apparently dragging it out as long as possible before they do). Because she chose to sue the operations manager now has a black mark against her and will forever hold it against her. Twunts. But thats the kind of company it is.

 

As far as your case goes Hirst, a specialist in employment law should be able to walk all over them by the sound of it. Still, its not a pleasant thing to go through so I hope it will all be ok.

What Pompei said, i.e do NOT walk.

 

If you are sacked then even if they (tribunal) find in your case I believe they are not at liberty to re-employ you.

I'd personally suggest contacting your union, joining one if you're not a member or speaking to a good brief/CAB.

If you can get someone smart in with you to the next stage then you should be onto a winner as hopefully they'll save it going any further.

Of course the bit about the union is assuming you have a union at work or that they 'recognise' one.

 

Ps: should it come to it they cannot suspend you without pay, a trick some dodgy companies are known to use.

Are we talking the Elite \ Eclat wheels all the JDM lads go daft for, or actual Piazza Handling By Lotus wheels?

 

If they're the latter, than they're worthless. Even the IPTOC think they're shit. I picked up a set of 4 for £1 on eBay. The seller was less than pleased, especially as he'd just spent £260 putting new 195\60 Goodyear Eagle Venturas on them......

 

Piazzas are twats to get tyres for BTW.

Granted everything for sale on the net nowadays is "ultra rare" but TBH you'd be lucky to get a tired set refurbed and diamond cut for the money he's asking.

Not having a go at you here mate, but I'm still sick of the VW scene wankers claiming everything they get their hands on is impossibly rare and hard to get hold of (Incidentally, they could do to learn the meaning of 'original' whilst we're here as well.)

 

I'm sure a positive offset wheel will make the handling just lovely on some half arsed slammed Golf shitbox.

 

Yes, indeed, they're so rare I've two sets in my garage. Obviously impossible to track down. I live 20 miles from a man with 15 sets in his garage. Bloody hell, unobtainable rims like these will naturally look amazing on a VW because as we know they're the only cars to use this crazy PCD.

Just been helping a mate move house. Some relation of his volunteered to help as he 'had a van' which turned out to be some sort of VW camper thing.

'Oh, I'm not putting that in there, it might scratch the cupboards' 'I'm not putting that in there it might make the carpet dirty' etc, so he ended up taking fuck all.

Then, just to cap it all off, he saw my Pisshat and said 'wow, someone else who appreciates a good car and a fellow dubber'.

 

I then happily proceeded to tell him how fucking wank my car was, I'd only got it because it's cheap to run and that I'd rather have a Vauxhall or almost anything else. That was the end of the conversation about scene taxed glorified vans.

I'd have a petrol one chief, 1.6 ideally. Even I'm put off the 1.9CDTi engines now after the 'experience' with a Vectra C not so long back.

I used a 1.8 or 2.0 petrol in work and they are totally gutless, the diesel is really good in comparison. I couldn't believe how cheap newer Vauxhall interiors have come.

A mate has an old 1.6 Zafira, one of the early ones. Pedestrian, but useful, and thus far (7 years) reliable.

SWMBO's got one (x-reg) - it's been generally OK, although we did get it with a replacement engine and it's had a new gearbox.

 

It's slow, boring but does carry kids, their stuff and keeps junk that needs to go to the tip out of my car.

 

Mind you ... she's also now asking for something better.

However, it has seven seats, which means he now gets stuck with giving all his son's mates lifts to swimming/rugby/football/birthday parties etc.

 

Lose/lose as far as I can see!

Could be an age thing but in all honesty speed really doesn't matter to me much anymore.

See what you mean, but when I said motorway speed, I only meant 65-70 :shock:

 

Although, on the plus side, it is big enough to be quite handy. Still wouldn't have one, though. :D

But really, what a welcome to the country. Get straight off a ferry where you drive on a motorway virtually to the port, arrive at Plymouth into some run down back streets then spend then next 30 minutes stuck in the town centre trying to get out along with everyone else who has just arrived in Britain.
