I bought a 2010 Seat Leon 1.9tdi with 60k and full history for 5.5k from a local dealer. 2 months down the line and the gearbox blew up. The dealer said the 6 month warranty would only cover a maximum payout of a grand. The total bill I was informed yesterday would be nearer 2.5k. leaving me out of pocket to the tune of £1500. I haven't paid anything yet. I thought when you bought a 2nd hand car they had to give you a 3 month no quibble warranty. Does anyone know where I stand legally before I part with the dosh?

Get in touch with Citizens Advice rather than take the word of the Internet.

 

That said I'm petty sure that a 5.5k car that lasts 2 months would be classed as not fit for purpose.

Speak to Citizens Advice. Take all your paperwork - invoice and warranty with you.  They can look at all that and give you a better idea of where you stand than chaps on the internet.

There are new laws on this. Consumer Rights Act, I think.

 

I think the guaranteed right to return is 30 days.

 

If you're past the first 30 days but a problem has arisen that you think would have been present at the time of purchase, then you're entitled to ask for a repair or replacement free of charge.

 

During the first six months after purchase it's the responsibility of the seller to prove the fault wasn't there, not for you to prove that it was.

My partner has just said we get a free half hours advice from the solicitors down the road. I think she's gonna try there 1st. I wouldn't care but I px-d my 2000 xj8 a 2005 grand scenic and £3500 cash to get something more reliable!

First things first - a motor trader does not need to provide a warranty. At all. Zero days.

 

Common misconception.

 

What they do need to do is provide a product that is of satisfactory quality and fit for purpose plus the new CRA 2015 gives enhanced rights to return / repair.

 

Any warranty they do provide must not restrict/infringe your consumer rights and will state as such in the wording.

 

Knackered gearbox after 2 months, low mileage and verifiable history? They're liable.

 

You need to have given them the chance to sort it though - if you've gone straight to a Seat main dealer with it hence the £2500 bill then you're on very dodgy ground.

The trader took it from us and took it to a gearbox specialist themselves. They have gave us a courtesy car in the meantime but are insinuating that we owe them £1500.

You don't and a well worded letter from a lawyer should make this go away, everything else seems to have been done right

Tell the to f**k off, their proposition sounds ridiculous if you ask me. If they are in the trade they ought to be able to get this sorted to a decent standard for much less than £2500.

£2,500 for local gearbox specialist* to do a job for a local trader. Are you sure you haven't bought a Nissan GTR and just pretending it's a Seat Leon?

Unless it's a DSG I can't see even at retail,' Clueless, vulnerable punter waving a credit card around' rates it could cost even the £1500 they want on top.

Has anyone actually presented you with a bill yet? Insinuating it might cost you £1500 doesn't really mean anything, and have you been offered the option of, say a new clutch? Because a trader paying a mate is just going to chuck the old one back in.

Yep, the warranty they've provided is irrelevant in this case. Sounds like the kind of nonsensical on-line policy I used to come across frequently in my old job.

 

Let the trader sort it out. Do Not Speak To SEAT!

My advice to anyone (won't be of any help to you unfortunately), is buy under a grand or buy new.

You've got to love these traders, still relying on the worthless warranty being, well, worthless, to hopefully absolve them of responsibility in the blinded by bullshit eyes of a bamboozled customer.

 

However modern VW group shit out of warranty...sod that for a lark.

1.9 PD is the benchmark.

Maybe they quietly know the warranty is fucking worthless and the repair cost to them is £1500, hence they've come up with this gig so they are not out of pocket.

yeah thats what i was getting at

 

did they fit a new clutch while it was apart ?    cant imagine a recon box would be much more than 5-600

If it's some fly-by-night dealer that's here today gone tomorrow your chances are slim if I'm honest. Often they've no property or anything so they'll shut down and rename themselves something else and start trading.

 

Yes in the letter of the law you've got redress, but on a practical level you could end up taking them to court ultimately and end up with them with a fine for £xxxx paid off at £1 a week.

Yep got to agree it's the only way.

 

I went out to a 15 plate Micra the other day only done 4000 miles and the starter motor just span up but wouldn't engage.

Turns out some Micra's are now made in India complete with shonky locally sourced parts,even the battery had made in India on it.

 

The dealer i towed it to refused to accept it as they had nowhere on the site for me to drop it.

I'm not going to say that they never go wrong ( Hondas 2.2 C tdi and some Toyota vvti engines have issues ) but they just have much better build quality than zee Germans . Don't let the soft dash fool you guys !

I'm still staggered at how many adverts there are in the papers from garages selling stacks of cars with no warranty,  Totally wrong.

As I said above, "no warranty" doesn't change your consumer rights. There's no obligation to offer a "warranty"

 

Granted the kind of trader that states that in adverts doesn't care what your consumer rights are
