Sold car, may not have informed DVLA :(

Hi guys long time no posting but could do with a bit of advice. I sold a car November 2010 on ebay, my memory is pretty poor but if I remember right I could not find the V5 for it & so knocked of the price of getting a replacement & sold it without the V5 :roll:

 

I have now received a letter from the DVLA to remind me that the SORN on the car expires the end of this month. The problem being that the only details I have for the buyer is his ebay user ID which is showing in my feedback details which is not ideal lol. I sent him a message via ebay a few days ago asking for his name & address so I can send them to the DVLA but no response yet. If I can't get his name & address what would be the best course of action?

Did he pay via Paypal? Could find his registered address that way

Write to the DVLA, explain that you wrote to inform them with the buyer's details last year when you sold the car, but now cannot find them. As long as you tell them you got rid before any fines arrive they should just take you off the record and wait for a V62 logbook application.

 

It is important to remember that you DID write last year when you sold the car and they must have lost it ;)

No he paid cash on collection sadly. I also tried doing that thing on ebay where you can obtain their address if you have a transaction with them but it was over a year ago so it would not give me it. I even thought about buying something from him to get his address that way but he has no items for sale :(

 

Good thinking SOC, I will give the buyer a few more days but if no joy I will send a letter Monday. The amount of post that goes missing means they will probably just accept it like you say.

First of all go online and sorn the car. As you have the letter you are able to do this. That buys you a year.

Have you tried using Goofbay to see if he's been biddingon, or has won, anything recently? Admittedly unlikely but if he has won something it could be worth dropping the seller an e-mail and asking if they have his contact details.

I thought of doing that but would it not look dodgy if I sorned it again & then wrote to them to say I sold it last year?

He does not appear to have had any recent ebay activity sadly.

 

I sold the car as a non runner & it needed a fair bit of welding so chances are it is just sitting on his drive somewhere.

Yeah, don't make the sorn declaration - you no longer have control of the car so promising you will be responsible for keeping it off the road for next year isn't a good idea. Send them the V11 sorn reminder with the letter, explain that its arrival is what made you realize they didn't know you haven't got it.

 

also, going to your local VRO (before they shut them all!) with the V11 and the story will get it sorted out on the spot.

I just actually phoned them now instead & gave the story of having wrote to them last year & now getting the V11 etc. They just said send them a fax stating the date I sold the vehicle & they will get my details removed for it. Not having the sellers details is not a problem according to person I spoke you.

 

I will fax them from work on Monday, hopefully that should get it sorted out :)

Wot 'e said. You definately DID write to tell them, and you posted it the same day.

Nice in theory, but it didn't work for me - ended up with a £35 fine or whatever it was. I send everything to DVLC as recorded or special delivery now.

The Postal Services Act 1984, I think, is one's friend.

It states a letter committed to the postal service is deemed as served upon the recipient.

DVLA rely on this, trust me, so use it first and you win.

I did.

They tried me for the same, a £35 fine I never got ended up as a £1000 fine and a summons....they got my address wrong and I quoted the above Act as in I posted the V5. End of.
