Am I legal?

Right chaps, I've just purchased a little Polo TDI smoker from a garage owner pal of mine, he's been using it as a courtesy car and is such the car is classed as being 'In the trade'.

 

I have taken out my own insurance policy, and my pal has suggested not to send off the V5 until next March when its current road tax expires as he's happy with it being down too him even though it's my vehicle now, would I be legal doing this?......

No, as I am sure you know.  Risk of getting caught and nicked is probably small though if you are good terms with him.

What is the advantage of keeping the tax on? If you SORN it on the evening of the 30th then transfer ownership and tax it on the morning of the 1st you won't have to pay twice.

If you read the post again it's taxed until next year presumably because it's been used as a courtesy car whilst with trade

Refund goes to the registered keeper.If a car is in trade there is no registered keeper (so I believe)

If the bloke has done it properly he has taxed it using the new keeper supplement - completing the transfer of ownership will mean the tax will stay on the vehicle

Sounds like the garage owner is just saying you can send off the V5 late and get the benefit of the tax he's already paid for. It's not technically legal, but who's to know? Anyway, if you ever get a tug, just claim you posted off the V5 and the post office are obviously twats.

As above, check the insurance doesn't require you to be the registered keeper.

I'd look into what Kiltox says though, if that's right then you can just do it properly

Owner and registered keeper (RK) are two very different personalities.  

 

You can be the owner without being the RK.  Oh, and you can be the RK without being the owner.

 

However, if the insurance co requires you to be the RK, then you had better sort out the V5.  If the insurance co requires you only to have an "interest" in the car, you can have such an interest by being the owner!
