Just what it says on the tin.

 

If you have a question, if no one else can help and you are to tight for proper legal advice from a trained legal person, then throw caution and common sense to the wind and ask away for totally bizarre advice.

 

I'll kick off shall I?

 

My local council have a bylaw that prohibits the sale of cars parked on the street.

 

They enforce this by gluing stroppy letters to the windscreen. They could take you to court....

 

 

Breaches of byelaws are prosecuted in a magistrates' court. The punishment is a fine, the maximum being generally between £500 and £2,500

 

now my argument would be that simply putting a sign in your window of the car with "£299" on it is not indicating it is for sale, but merely an invitation to treat, ergo I am not  selling a car. If it is taxed and insured and not contravening any parking restrictions then the council should stroll on. Any  large notices glued to the window would be treated as a trespass against my property and damage.

 

Over to you mates uncle wots a proper lawyer....

Whilst it may or may not be enforceable - I know slightly less about lawyering than I do about quantum mechanics - what it does seem is really fuggin' petty. What harm does it do? It's hardly like your street is going to turn into Yes Car Credit overnight.

Tons of that kind of thing goes on round here, always 2 or 3 cars lined up in the street with signs made out in the same style, etc. No-one seems to do anything about it though.

Theres a road near me and there's about 10 cars for sale in a row, and one nearby with another load of cars. Even this is taking the piss but I suppose it's someone making a living. I'd hate to live there though.

Advice (in a lawyerly fashion):

I'd need to see the actual byelaw they say you are offending against before I could advise whether there appears to be evidence to support an allegation of a breach.
