What is the average penalty for having a small bump with a driver who wants to go through insurance, and you don't have any?

 

Background:

 

MrsBeko and ProtegeBeko (MB and PB, saves aload of fuggin typing!) are out with MB's friend. Lunchtime-ish. Her friend is called SC (SillyCow). MB and PB met up with SC out and about, so followed each other around for a bit dropping off children and doing wimmin stuff.

 

MB waits for SC in a bus stop :roll: and SC turns up. Fags smoked, they get in and depart. SC is infront of MB. SC indicates, looks, looks again and pulls out.

 

I introduce RB (RandomForeigner) in a car I do not know the model of.

 

SC pulls out at the second RF passes her, and they exchange paint. SC didn't see RF anywhere, backed up by MB who was looking to pull out too. Both stop, and at this point the details become tetchy (I got a phonecall from MB about an hour later. She was blabbery)

 

The impact was behind the front wheel and I guess along the bottom of the door. I don't think dents were made but paint was exchanged . Was a slow thing.

RF is apparently late for work, so phone numbers and addresses are hastily exchanged and RF buggars off. NO FUCKING PHOTO'S WERE TAKEN :evil:

 

However, and this is the bit that ended the issue before it had begun, SC's insurance lapsed about 10 days ago. She has nothing, as a quick call to her insurer confirmed. RF has given her details to her insurer. Buggar, there goes my idea of smiling sweetly, bunch of flowers and a weekends worth of me polishing the damage out and job jobbed. It's a 56 plate car, so I imagine it's dented slightly sadly.

 

SB keeps asking me what might happen and I have no idea. She realises she's going to have points, fine, court and I'd imagine the car crushed. Anyone have experience to give me a ball-park estimate?

 

My bright idea is to sell her car ASAP, use that money to pay any fine and get her something out of the tat thread.

Best case available for no insurance is they offer you a fixed penalty of £200 and six points. Worst case is unlimited fine, a ban and a short spell in jail.

I know a lady who's insurance lapsed over a reminder she didn't recieve,and her husband assumed she had insured the car,and she thought he had done it.They both have same make model cars,so it does get a bit confusing;she went through a police anpr and was pulled over for no insurance.

 

Car was seized on the spot

Had to pay to have the car back from the compound once she was reinsured,however ...

 

Because she was pulled over for no insurance,and given 6 penalty points,her insurance company stated they would no longer insure her once the points were on her license.She gets the insurance,and gets the car back.Now that they won't insure her after 30+ years,she looks for new insurance.

 

New insurance company asks " Have you ever been refused car insurance " Answer is yes

 

Verdict - after finding someone to insure her,over £2000 a year for a 1.1 206 !

police policy is not to sieze a car unless driver admits its not insured.

Insurance policies now rather annoyingly often auto renew and you have to write to them to cancel so its quite difficult to do this - but obviously thats not all policies.

 

I have some sympathy if its a genuine mistake but really how hard is it - and driving with no insurance is out of order.

 

If it were me I would call RF and say that don;t want to lose no claims or some such and that SC will pay at bodyshop of RFs choice

It's no excuse at all to not have a policy, it's the second thing I check has been paid along with the rent before I start spending.

 

Although, MB is driving home now and I've just got off the phone to her.

 

Back in late octoberish, her insurer asked her for some no claims proof. She sent this. They wrote back and asked for more. She sent more proof, and heard nothing. This was at the end of november. I'm hoping the lack of contact after the last letter and subsequent cancellation may help her side (although not much)

 

Being a single mum to two on benefits I expect she can pay her fine back at £5 a week, and then not be able to drive through being shafted for new insurance.

 

I've certainly used it to teach MB a lesson - TAKE PICTURES OF FUCKING EVERYTHING and have insurance, obviously :D

So did it lapse cos it ran out or did they effectively cancel as they didn't have proof they needed? I thought that was all electronic now too - sounds like there may have been an issue with the NCB? But if they took money and didn't get something saying it laspsed thats out of order

It's got me thinking too, I didn't know that earlier. They didn't take the money, she needs to pay that on wednesday as usual, but she's had no letter or contact. I've advised MB to tell her to get her paperwork in order and either bring it over here and I'll look at it, or put on the mother of all stupid bint shows and hope they fall for it, with a bit of money and the aformentioned NCB issue thrown in

No points or fines, because the police were not involved. The other insurance company will write to SC to recover the costs of the repairs and she'll have to pay them out of her pocket. It's as simple as that. As long as she doesn't refuse to pay it or ignore their letters there won't even be any legal bods involved. She can even explain her financial situation and offer to pay in instalments and there still won't be any legal or court involvement. If, on the other hand, she chooses to ignore their letters, it will go to their debt recovery firm (usually a third party) and it will rack up additional costs.

That would be a lovely outcome. She is fully prepared to pay fines, get points etc. Her clio would be cleaned up and sold if the fines were fairly large.

 

Should she tell someone about this to pre-empt any issues and hopefully look more favorable, or just wait for contact?
