eBay seller woes

Hello all

 

I received a phone from an eBay seller yesterday. It's a BlackBerry Storm, and the screen (touch) doesn't respond. The phone was described as having a small crack in the screen, but the Top part of the advert where it says "Item Description" said "Used: An item that has been previously used. The item may have some signs of cosmetic wear, but is fully operational and functions as intended. This item may be a floor model or an item that has been returned to the seller after a period of use. See the seller’s listing for full details and description of any imperfections"

 

I don't care about the small crack in the screen, and he did indeed point it out, and posted a couple of pics. However, nowhere on the ad did it say it didn't work. . In fact, as stated above, it plainly says that it DOES work.

 

Any ideas what I should do, folks?

Hopefully you paid by Paypal in which case you're laughing. You'll have to wait (I think) for a few days then open a 'SNAD' (seriously not as described) case and Paypal WILL refund you as they always find in favour of the buyer.

He replied just now to say that he was "Selling it for a mate, and didn't know it was busted as he hadn't used it". It also seems he posted the ad from a mobile, so I reckon he might not have seen the top part of the ad about "used and working". He's only had 4 transactions too, so maybe he's just an inexperienced seller. Or a fucking idiot for not checking it.

 

Thanks for the advice chief, I'll open the SNAD with PayPal forthwith.

One reason to buy from Ebay and pay through Paypal, he's over a barrel with his pants down as it were. :lol:

For SNAD poopal will tell you to return it at your cost. Make sure you at least send recorded so you don't get the old "never got it back m8" scam.

ask the seller to pay for return by courier company. That always pisses me off when a return is in order. :D

Cheers for the advice folks. I think I shall be asking eGay for a label, as I'm not paying 11 quid to send this lot back. Ironically, 11 quid is the price of a replacement screen, so I'll give the seller the chance to buy a screen and send it to me. I can then fix the phone, he won't get negged and he'll be no worse off. However, if he gives me any static, I'll make sure he gets dry-bummed by PayPal and eBay.

UPDATE: Seller-mong contacted me this morning after I started the PayPal dispute. He's still gurning, but has agreed to refund the price of the phone and the price of me posting it back.

 

Thanks for all your advice everyone - I was all at sea for a bit with this.
