Anyone know how it works?

 

Idiot sister has bought a mingebag spec motoring kia picanto today, which has been dumped in the back garden while she flogs her previously ruined car.

 

A bezzie mate of said idiot has convinced her that 'cos it's taxed and not insured by her (seller delivered it) the dvla will come and crush it by 9am tomorrow morning. I think this is rather unlikely, as until they've processed the V5 they don't even know that she has said car. Can you even declare sorn on a car that you're not officially the keeper of?

If the seller delivered it then presumably it's still insured under his name. As long as it appeares on the MID the DVLA won't bat an eyelid. Even if it doesn't, the first step is a warning letter, second step is a £100 fine, and clamping/crushing the car is a last resort. So basically what she's been told is a load of bollocks.

I'd just wait and see. As far as I can tell, the first action by DVLA is a letter saying "you are taxed but uninsured, do something about it" and all the fines/crushing/court action threats are about what happens sometime later if you ignore them. As you say, they won't even have processed the V5 yet, so I'd guess itt will be a week or two before they even notice. When/if they do, plead ignorance and either insure it or make SORN.

 

PS, if she asks her insurer nicely, they will probably cover both cars for a month for a nominal fee as she can't drive them both at the same time.

I'll be interested to see what happens if anyone tries contesting the DVLA if/when they supposedly start dishing out these fines for having a taxed but uninsured car locked away in a garage somewhere, it sounds like the most ridiculoous 'crime' of all time.

It seems to me that a lot of new legislation never gets tested in a court due to the "pay now or pay double" fixed penalty notices.

 

I'm waiting for the council to take me to court over the appaling OMG_ENVIROMENT damage that 6 bags of soil and stones is causing. They have threatened me twice with a fixed penalty notice of £110 and been told to nick off.

You've plenty of time before this becomes 'an issue'.

It'll take 2-3 weeks before its registered to you. Add another 4 weeks before DVLA take any real note. 4 weeks after that the letter will come out -so essentially, youve 2-3 months.

 

As above -they'll write first, and they cant remove from your garden or immediate environs (curtilage I think they call it)
