Father Ted Posted June 30, 2010 Posted June 30, 2010 1) How do I go about claiming a patch of land under the adverse possession rule that I have been using exclusively for the last 16 years and is fenced off for me? I could do with getting the boundary on the land registry entry altered to show this patch of land is mine (not mahoosive - just 15 foot by 3 foot). 2) I have a christmas tree growing merrily in the garden (one of those cheap B&Q jobbies that cost a fiver at crimbo and they say wont grow if planted out) its now 12 foot tall which is a nice height thank you very much. Is there anything I can put on it to slow the growth down so it doesnt go too loopy?

Rusty Pelican Posted June 30, 2010 Posted June 30, 2010 Did the same with a crimbo tree , one of those pot grown jobbys ,You chop the top off as I did , although mine eventually grew not one but two new tops in a V shape , ive loped them off now , maybe three tops next year then

Father Ted Posted June 30, 2010 Author Posted June 30, 2010 Its a bit complex Pog - my garden is supposed to have part of an access road going through it (my house was originally a different design then the original developer went bust and another cheaper design was dropped in its place on the plot. Weirdly the plot was never altered for the land registry). So, garden doesnt resemble plans - there is no road running through it and my drive way comes out somewhere else (which pleases my neighbours as he has more room to park his cars). So for the last umpty years the road (15 foot x 3 foot strip) has been lawned, and for the last 16 years its been fenced off to make a very nice garden. So what to do - keep mum and just live with it or try and get the red line moved and lose the road off my plans once and for all.
pogweasel Posted June 30, 2010 Posted June 30, 2010 I would be inclined just to leave it 'as is' for now. Any attempt to reinstate a highway across it would require revised planning, in which case you would receive notification. That's the point where you need to get into adverse possesion.
