MID question

I've just had a £50 fine through the post for failing to insure one of the fleet. Completely my fault - I forgot to ask my insurers to add it to the MID (now rectified, needless to say) as it's not a car I really use. Question is, will the DVLA cancel the penalty if I send them a copy of my trader's certificate (on the grounds that I was in fact insured to drive the car) or will they take what seems to be the standard police attitude that the MID's word is final and if it wasn't on there it wasn't insured? I would imagine that if they were to prosecute and I were to turn up at court with my insurance certificate I'd get off, but I'd really rather avoid the hassle.

I doubt it but it's worth a try. It's only the price of a letter after all.

I would say 100% defo send them a copy of your traders cert and a note saying you will not pay the fine full stop. See what happens next! I bet they will either drop it, or do their usual thing of saying 'see you in court' and then dropping it if you actually turn up to argue the toss with them in court.

Also don't forget you get two weeks before you have to add it to the database AND the whole inputting system is a crock of crap as it can take days to go live.

I had a problem with tradex they have a habit of charging you £1.50 for a text to add a car then they don't do it. According to the copper who pulled me up they are well known for it and she told me to send tradex a bill for the time spent being pulled over because they didn't do their job. I have changed insurance companies now as I found out that tradex hadn't added a moped I had even though I had text them and phoned them about it luckily I didn't get the fine on that one even though it wasn't on the database for over 6 months. It will be a tricky one to get out of really unless you can prove that you had put it on and it hadn't been recorded. I think the offence is the not adding it within the 2 weeks rather than being uninsured. It might be worth trying to fight it if they are prosecuting you for no insurance as you were insured and can prove that, but if it is for failing to notify then I think they have got you on that one

The offence mentioned on the letter is "keeping a vehicle without insurance". There's nothing mentioned about not inputting it on the database. I'm not sure they've actually managed to make that a specific offence yet, although they try to imply that it is.

 

I reckon I'll just fill in my insurance details on the back of the letter and send it back - if the DVLA get in touch with my insurers the latter might whinge at me for not having added the car sooner, but it's hardly the crime of the century, even though I have had the car for rather longer than two weeks... :oops: I'll attach a covering letter explaining that it's a trader's policy which covers me to drive anything that isn't specifically excluded, and that I don't intend to pay any penalty for that reason.

Was the vehicle in question being used at the time,or in storage on private land ?

Can you get an endorsement for keeping a car without insurance or do they actually have to catch it on the road for that?

It was stored on private land, but it was taxed, hence the need for it to be insured under the daft new rules.

 

Keeping a vehicle with no insurance is a non-endorseable offence so it'd be just the 50 quid fine - not the end of the world, but it's the principle of the whole thing.
