From what I recall (and its a couple of years since I had to do any of this so I might not be 100% correct but its about there), if a car is driven by an uninsured driver and crashes, even if that driver is not insured by the company that insures the car, the third party can still make a claim against the insurer of the car. Its then upto the insurance company to recover their costs against the driver or policyholder.

Of course this makes a mockery of the fact that when you take out a policy you're insuring YOURSELF and specified drivers while driving a specified car, not the car itself (as is the case in the USA and other countries).

Logic goes out the window...

so infact we are all insureing our cars for any driver even a theif for third party cover  i wonder if i just drove anyone elses car without insurance the police would let me off on the basis that the owners insurance will pay up.

Exactly. I'd be hiring a solicitor if an insurance company tried to "recover" money out of me personally on the basis of a thief ending up in a wheelchair after stealing my car.

As an aside, a portion of every car insurance premium you pay goes into a uninsured drivers fund run by the MIB.

I feels for ya mate..my 2cents worth..back in 1986 when i was a mere 19..living in the Highlands..i bought a Honda XL125 which was to get me from Strontian over to Mull where i had a forestry job.One Friday..the gear spline was worn ta fook..and i couldn't engage it..so as I was leaving..a similar spotty yoof I worked with asked if he could borrow it once fixed. So i obliged and went back to Strontian...and then came back the following week. What happened was that Yoof drove it onto the mainland-Glasgow and got pulled by the cops..i.e no insurance. The Strontian police contacted me..went round to me Mums..and then in the process I moved down to Edinburgh..I was then visited by those plodders one evening..and then later when I had my own flat..two plodders drove all the way from Greenock and charged me with said offence..i couldn't believe how much cop time went into all of this but a lesson well learnt..hope it all works out for ya mate...

I don't think there's anything constructive I can add, really, except to echo what skoda-fan said. We're all here because we enjoy our old cheap cars. Don't throw that away, it marks you as someone special. A bit of fleet-reduction is normal, if heart-tugging, but don't clear right out. That wouldn't be you.

Best of luck with the insurance thing.

Have a good read of the insurance policy, there are get out clauses which you can sometimes use yourself - ie,was your friend driving the car on your instructions for work purposes ? Was the car being road tested/delivered on your instructions.Traders policys can be very flexible

Sometimes there can be little loop holes you can easily slip onto

Having read through the whole sorry tale I am simply left with a headache the size of a small town. I have nothing but sympathy for you and I wish there was something worthwhile that I could add to the process. I would really be looking at how viable continuing with this 'mate' would be and I would certainly be recovering anything car shaped from his grasp. We all try and help mates out and I also am very selective about who I consider a true mate, however, I think he is taking the mick somewhat.

I have long come to the conclusion that I have an old car addiction and have said yes to many a car then thought about how and where. Do you know what? Bollocks to it. Long live the addiction.

By all means rationalise the fleet but never say never to potential additions (just don't lend them out to anyone unless you do the V5 thing as mentioned earlier).

I wish you all the very best and I hope it gets sorted out with a healthy dose of comon sense.

Actually just out of interest, what is this mate of yours doing about the predicaments he has placed you in?
