DVLA - really getting up my nose

Today in the post - a Faliure to Notify disposal of vehicle fine for a Morris Minor I sold in April 2009 -

 

According to the DVLA I didn't inform them - I did actually - ut have no idea of the whereabouts of the letter nor do I have a rec0ord of who I sold it to 2 and a half flippin years ago!!!!

 

These twunts seem to be rolling back the database trying to pick up cases like this - am tempted to write back along the lines of:

 

"This car was sold in April 2009, I no longer have the record of who I sold it to but as the car was last liable in July 2010, you clearly do. I cannot recall whether or not the DVLA sent me an acknowledgement letter."

 

and seeing what happens - it seems particularly sneaky of them to be digging back 30 odd months and I've checked through my recent V5 reciepts and noticed that I am still missing several -

 

I have 2 current court cases on going over others - in both cases I informed the DVLA, didn't get a letter and then didn't call to chase there whereabouts of the letter -

 

I know Pete-M has had a run in recently but are others finding the same?

If this is true I could have a few fines coming my way!

 

They resolutely refuse to SORN my Volvo, they wont let me do it online so I had to go down the post office and do it there- its still showing as UNLICENCED on their website. Bet I end up getting fined.

 

If you do go to court there's a good chance their case will revolve around you not getting in touch with them when they didn't send you a confirmation letter. I've read somewhere that isn't your responsibility. I think it was PETE-M who was involved but i'm not sure. I think its all pretty much defeatable if you want to take it all the way anyway.

I have just realised that I haven't received the SORN confirmation letter for the Allegro. I have just checked the database and it shows it as unlicenced yet I have a confirmation e-mail saying that the SORN application was successful!!

 

Do I try again tonight or shall I ring them and ask them what they are playing at?

They don't even answer my letters/application or emails now, but they expect keepers to jump through hoops when they write!

Don't waste your time/money phoning them; just make sure you keep the proof of SORN for when they send their stupid letter/fine.

Wow! The reason I'm here and not in work today is that I had to make an appearance in the local mags court to defend a charge of failure to notify of change of keeper!

 

Needless to say they backed off before going into court.

Can you stick them for £250 expenses too? Be great if you could!

 

Someone should start up a "DVLA R TWATS 100% NO WIN NO FEE LAWYERS 4 U" company, take on as many cases as you can and really rip the DVLA to sheds.

Alas no expenses I'm afraid, they drop the case before you enter the courtroom.

I worry about something happening every time I buy a new car or send a log book off.

 

utter wankers. did you see that Watchdog episode about them? scary really as they do not answer to anyone so its your word against theirs all the time it seems.

Intend to use this myself as Horsham is one of the courts I'm eing dragged to Romford and Edinburgh being the others.

 

Daf 44 - this case was judged in my absence and I was informed post judgement. I have written to the court requesting it reopened, which they have, and now requested the case be transfered to a court nearer my home. I have also logged a pre court settlement offer to the DVLA informing them that if they drop the charge and update their records then I will withdraw the claim for costs they will be getting from me.

 

Shogun - this was sold 2 years ago - fuinded for no tax in Horsham, despite me being 400 miles away a the time. I was due in court last week in Horsham for this one and had intended to travel down however, ended up in hospital as well, I have witten to the court and the DVLA stating Peck vs DVLA and advising them to drop it - making them understand that if I have to travel to defend it and if it is found in my favour (which it will undoubtably be) then I will be claiming 900 miles mileage at 45p a mile, 2 nights bed and board £80 per night, £15 per dieum for costs and £400 per day for 2 days of my time at my usual consultancy rate - we'll call it a nice round grand. So far they have yet to respond but I did get a very aggressive DCA who are chasing me for the 'ticket' bit of the fine and who had a 'lawyer' call me up and try and bully me into paying £350 or he would 'instruct bailiffs' - which of course let the cat out the bag that the twat wasn't a lawyer as, of course, we don't have bailiffs up here and if he really wanted to attempt a Statutory Decree in the Sheriff Court then I'll see them there! - told them if the call again they wil be guilty of trying to enforce a debt under dispute which is against the law and inspector knacker will be told along with the OFT.

 

Fucking modern world is unbelieveable - what is wrong with our contry Mr Cameron???? well it's arrogant authority which shows law abiding subjects no respect and assumes, in direct contradiction to EVERY legal right we have fought for over the years by attempting to enforce a - guilty until proven innocent approach to law. The glue of society is the trust that exists between the individuals and organisations that mke up that society. As soon as one party abuses this and starts to, by defualt, distrust the others sociecty starts to disintegrate.....you want to find out why7 our country is shit? well it starts with banks refusing to refund customers who tustingly paid money into a drop off point to discover it had never credidted their account (Barclays - Sunday Times this week), The DVLA making you responsible for THEIR errors, and leads to asociety where,rather than look out for each other and be reasonable, we start to look after number one - see what we can get away with...MPs...phone hacking....rioting....but it STARTS with respect and trust and being reasonable...

Good luck with it. I'm happy to say I have a 100% record of not paying DVLA fines. I find it appalling that they behave as they do, but as you say that is how things are now. My recent visit from a council "warden" sort of confirms it too - reasonable, polite behaviour has given way to a bullying twat in a van and a hi-viz giving out "penalty notices" for nothing.

I too have been on the receiving end from the fascist orifices down in Swansea. I suggest a resource area/thread on this forum for those experiencing similar hassle, which I'm sure would be very useful to all the forum members.

I think I'll begin sending an empty letter to divvy-la once a month, getting a proof of delivery, keep the proofs somewhere safe to pull out as and when needed as an easy means of defence. My best yet is pulling off a wheelclamp and getting away with it, my own mistake, I forgot to get a taxdisc, all the dickshit-vla had to do was tell me the tax was out and I'd have been straight on it, but no, they have to behave in a way that would shame the gestapo.

Quite a few of my ancestors gave their lives in horrific, obscene battle while cowards hid under their mothers skirts, only for their descendants to introduce and enforce corrupt legislation. Bill of rights, 'Fine or forfeiture before conviction is null and void' FFS.

Looking forward to the legislation that will get railroaded in on the back of the riots last week, to fuck over everyone except actual rioters.

I just wrote a snotty letter to them, got one back saying yeah but you owe us. So quoted all the court cases and sent it back. Finally got a proper letter saying they were looking into it and then one about 2 months later saying it isn't going anywhere further. All cause they thought they claimed i hadn't informed them. Bollocks to that.

I had two cars that were not taxed but were parked off-road car parking - both clamped on one snowy morning. I removed both, put one of the cars in a safe place and they came back and clamped the solitary remaining car again. Crimson with fury, I removed it again (taking a grand 7 minutes this time) and put the car in the garage (I had just rented the day before).

I've had one letter spouting the usual strychnine about an unlicensed vehicle and put a reply in writing that I'd planned for a couple of months and haven't heard anything back since. No doubt they have moved this straight onto a bailiff, bypassing any court procedure!

 

I had to pay 250 quid to release my car from a compound after the DVLA fucked my license up. I paid the fine just to have my car back as I wasn't going to go through the mountains of hassle and building up the 35 quid a day storage fee these unreasonably difficult fuckers charge whilst the director of the recovery firm is giving the reacharound to the chief inspector round the back of the masonic lodge.

 

I'm happy to pay taxes, but a quango that is run by monkeys isn't getting any more of my hard earned money, they can rim their anus' with their stupid fucking letters til it bleeds.

If you are getting letters from DCAs, write back saying the fine is in dispute and any further contact will be considered harassment and reported to the regulatory authority. That will stop them cold.

 

 

Still waiting for my court date after sending them a letter months ago quoting dvla vs Peck (lots of very useful stuff on Pistonheads regaring this)
