And I need legal advice -

 

Normally I would leave this to the insurance company but A) they would wright the car off, and B) this is my only means of transport right now as everything else (Mongdeo, 75, Escrot, both Sierras and the Orion) are off the road with some fault or other.

 

Basics are that a HGV pulled out from the (wrong) side of the road into the rear wing of my recently purchaced wedge 416. Bumper is torn off, N/S tail light has had it wheelarch has been pushed in and looks like a tin poener has been taken to a 2"x3" section and the rear wing has scrapes/gouges to the paint where the truck slid up the wing. I spoke to the manager of the company and he told me to put my claim in writing with pictures (have shots of the damage).

 

Trouble is this is my only means of transport atm and as such, I have had no choice but to buy a replacement bumper and tail light from the breakers. I know I can repair the damage to the wing and as such I have bought primer, topcoat, laquer and all sundries needed to repair the car to as good as standard as it was pre accident. Sheet steel (laying round the shed) and MIG are primed and ready for action in the garage

 

I have'nt got time to wait around weeks for the assessors to turn up and offer me some bullshit price of what the car is worth (approx £450-500) and let them wright it off, so I am going to repair it myself.

 

As I am going to repair the car, I thought I would send them a letter asking for my costs to be reimbursed (minus labour of course) as I dont have time for them to decide what they want to do whilst I am left without transport. The bill comes to £75 and I am happy for this to be paid to me and for the matter to be concluded. After all this is the fault of the HGV driver and I am saving them a considerable amouns from £75 to the value of £500 for a replacement Rover 416. I do have reciepts for all parts & items purchaced and as such I thought about putting copys of these into my letter to show proof for settlement.

 

What do you think? Any good or would it be better for me to post shit through next doors letterbox?

Put your claim in writing by email to the company, attaching photos of damage. Tell them it's your only mode of transport, so if you can't get a quick conclusion, you'll need to rent a car. Tell them the car's worth £500 and you'd like to keep it, so will accept, say, £350 plus salvage. Chances are they will pay you directly to keep their claims history clean, expecially if they know there will be no PI claims and all the other bullshit that usually pushes these claims up.

 

Emphasise that you would rather get this sorted cheaply, and will work with them, but don't let yourself get shafted, at least get paid for your time to repair the car.

Seems fair enough to me.

Somewhere in the law/your policy there's a duty to keep your claim to a minimum ie if you're Robin's written off you don't hire a Roller as a replacement.

 

I got hit up the 'arris by a 7.5 tonner when I was on my Fzr1000 EXUP, luckily fat rear bike tyres are great air bags!

 

I 'ordered' a new exhaust silencer at £400 odd!! and fitted it, sent them the receipt after phoning them and saying it's only vehicle so either pay the £400 or I hire a bike til you finish pissing about with your assessor cos I need my bike tomorrow.

I stated my duty to keep costs reasonable, which I had done, and added £30 for phone calls and messing about and they coughed up!

 

Result.
