MOT exemption help.

In isolation, many of the official gov/DVLA websites make statements which appear to be clear, if not completely straightforward.  The confusion begins when you read the information on more than one website.  I had the various MOT exemption pages come up when I retaxed my Reliant - it's been in the Historic tax category for years as it is a 1961 vehicle.  Re-taxing went without a hitch despite the MOT having recently expired.  It is roadworthy and unmodified.  Great, I thought.  All done.  Vehicle enquiry shows green boxes for tax and MOT, with the MOT being recorded as 'No details returned' .....because exempt.  Logical enough.  Then I looked at the MOT History DVLA page and it has a bloody great red box saying MOT expired and threatens execution, prison and confiscation of your bollocks if you dare to drive without an MOT.  A bit worrying.  Further reassurance was not forthcoming when the infamous Form V112 raised its muddy head.  I MUST make an MOT exemption declaration using this form at a Post Office, it said, after which it mentioned newly declared Historic Vehicles, re-taxing and modifications which, dependant on when such mods were carried out, may or may not allow MOT exemption.

 

Now, I definitely think I may possibly be legally taxed and MOT exempted.  I may grab a form V112 and fill it in to wave in front of nice Mr Plod if challenged.  I'm not thick (I'll only admit to getting a bit old) but I reckon the new MOT exemption information would be a lot clearer if it wasn't scattered around different websites, some official, some opinionated, some with club interpretations.

 

Yep. In agreement with many previous posters it's a muddle. if in doubt, ask the DVLA and/or a friendly policeman.

Didn’t the rules for HV tax change too? Ie; if the vehicle was a modified vehicle it could no longer be HV tax class and no longer tax exempt.

No, the rules for HV tax didn't change. i.e. A vehicle can qualify in the HV tax bracket and still require a MOT.

Now come on. You and I know that's about as reliable as asking fat-bloke down the pub. Or bloke on internet.

 

This self-declaration thing is just a piece of administrative bollocks. Nowhere on that V112 is there any vague threat of death by the authorities for not doing it right.

 

If you fail to advise of change of address on a driving licence - they tell you a grand fine. If you make a false SORN, they tell you 2.5k fine and time in the clink. Penalty of V112 declaration or lack of? Can't see nothing! The law hinges on what the vehicle actually IS and not what anyone on a bit of paper or tick-box declares it to be.

Off topic - but I often wonder how many people are ever done for failure to notify change of address on V5c, licence etc?

 

I bet the number is very close to zero.
