er no...it's not. a common myth.

 

Wheel clamping without specific statutory powers (ie Police or DVLA etc) is illegal under Scots law which has a very strict interpretation of the the law against blackmail...blackmail is a Scots word and the4 historical reason for this is that it was a custom, when skint to lock up your neighbours or tenants in your cellar until they paid mail money..."black" in Scots means "eveil or bad"

 

In Scotland until very recently both the police and the DVLA have the power to clamp cars. The DVLA do this regularly in Edinburgh and are quick to act. On the 14th of the month it is commo to see quite a few cars clamped. Feckers got me last year!

 

Changes were made to the law in December 2009 at the request of Glasgow City Council to allow them to enforce fine collection through clamping. ie - you don't pay your parking ticket, they will clamp you till you do.

 

This would tend to back up my mate's assertion that the above picture is a recent one and obviously taken on a mobile phone cameras on which were pretty rare 10 years ago.

 

So the city you can be clamped in is Glasgow but ONLY by organisations with specific statutory powers

if they were clamping without stautory legal authority (ie - law laid down by the Scottish Parliament) then yes. They have to clearly state this and prove it if challenged. As clamping without this tends to lead to a custodal sentance, they are quite particualr on this.

 

However, as it is a stautory power, you are able to challenge it in the courts if you had the means/time. The famous case about 10 years ago that resulted in a private4company being prosecuted, the clampers arrested by the polis and heafty fines for both the clampers and the directors of the company (who were London based), was caused because the clampers clamped an Advocate's (Scottish Barrister's) car and he called the police rather than pay the release fee...much amusement when the clampers were shuffled into the back of the Tranny in cuffs.

 

If you do get clamped up here they are usually always within thier rights to do so and make very sure of this. I suppose that at least you aren't being shafted for £500 by a bunch of villans as the process and level of the fines is strictly enforced. The DVLA started to use clamps up here about 3 years ago - before then they just used to tow your car away, a strategy that councils tend to use more frequently than the clamp.
