Continous insurance for all motor vehicles including SORNd ones

Not sure how many people will be aware of this but the latest greatest idea to come out of Europe and be put into place by our government is up for consultation.

Have a read, I was made aware of it via my links to Motorsport as it's going to stuff a lot of people there if it comes in - hello yes I would like 3rd party insurance on a MX or trials or race bike please, no it's not registered or MOTd and will never be used on the road....

 

If you have a nose through the government websites on the internet if it comes in unchanged I read it as all mechanically propelled vehicles will require a minimum of third party person cover even if on a sorn/ unregistered and stored where the public has no access to I.e your garage/ drive

Aye, grim news for all concerned - if the comprehensive ruling passes, which it probably won't. 

It's all on hold because of Brexit; I imagine the DfT is probably more concerned with getting the new MoT regulations through. We're still waiting on that as well. 
Been speaking to a few MEPs about it. 

The European Commission put forward an amended ruling which limits the ruling to all vehicles 'in traffic', so no more than basic insurance requirements as they exist now. Member states also have the right to derogate any vehicle it deems appropriate out of the Motor Insurance Directive. 

There's wriggle room and a lot of the insurers I've spoken to don't think lay up cover would increase massively even though the budget to fund the MIB's hit and run cover would have to go up, raising insurance firms' contributions at the same time. 

The consultation finishes on March 31 at 11:45.

This arises from the Vnuk judgment – a case heard in the Court of Justice of the European Union in 2014 on a reference from a Slovenian court involving an accident in which Mr Vnuk was knocked off a ladder by a trailer attached to a tractor in a barn. The Court ruled that the vehicle should have been insured on the basis that the Directive requires compulsory insurance cover in respect of any use of a vehicle that is consistent with its normal function. The Court interpreted the Motor Insurance Directive in a way that was different to the UK Government’s understanding of the Directive.

 

The EU Commission suggests amending the Directive to limit the effect of the Vnuk judgment.  The UK gov prefers this approach.

 

The car press will be full of OMGEUROKAOS articles, but I suspect that in reality little is likely to change.

I can't see the point of demanding laid up cover.

 

Actually I can't see the point of demanding insurance for (several) piles of bits in my garage and on my drive - why does anyone (here or elsewhere) think this would be needed?

Because think of the fines they could automatically send out if you didn't have cover??

 

Just because it's an absolutely stupid idea doesn't mean the gov won't welcome it with open arms, think of the publicity "Our new insurance enforcement ment we siezed xxxxx uninsured vehicles and saved 3 polar bears being kept in one of them, we successfully removed xxxxx older polluting vehicles from their owners and prevented them from causing further enviromntal damage"

 

Anyway we in the UK aren't French so we have to do what the EU says up until the point where we don't any more.

Don't panic just yet:  see alcyonecorporation's sensible comments above.

 

The Government is not keen on widening insurance requirements.  See the document that I linked to in my previous post.

The consultation contains some questions about enforcement.  Government doesn't enforce the existing laws - kids with motorbikes are zooming about without helmets, registration, insurance, MOT etc all the time around here and no-one cares.  The cynic in me thinks that DodgeRover has a point and they will leave the kids riding down the street giving me the middle finger alone, but send me a bill for my SORN projects since I am by far the easier target.

 

Hopefully I am just a grumpy old git.

On the face of it I can't see a Government going for this that has already made it easier not to be insured by simply deleting the check requirement when obtaining VED.   

 

Why does the ruling not cover ladders being insured when not in use?    I am always tripping over mine.....

Here in France all cars are supposed to be insured at all times, even if its a ruin at the bottom of the garden.....the thinking is fire risk, people injuring themselves on it etc etc.

The reality is many people dont, however the side effect is that it is surprisingly hard to cancel an insurance policy without having proof of selling the car or transferring to another insurer.

 

When I laid the Mazda up for a couple of years I managed to cancel the policy by saying I had sold it, but when I went to re-insure it (with a different company) I had a massive ballache and ended up having to forge some ownership transfer documents and pretend my registration got eaten by a dog to get a duplicate find an entirely legal workaround.

I wouldn't panic too much about this gents - it does the rounds every 7-10 years and has done so believe it or not, since the 1960's. I know this as I've got an old Car Maniacs (I think) from this era and the editorial goes on about it in a rather 'Shock-horror' fashion IIRC.

 

Most of these half-arsed ideas are just proposals put forward by those trying to justify their existance/continued employment - esp in the Euro parliment - and have little or no chance of coming to law, in this case for the reasons most of you mention above!

I don't know if many people are aware, there is a plan currently awaiting approval to make it mandatory to have insurance for all sorts of vehicles that are used off public roads.

If you fancy a track day costs could spiral, lawnmower racing anyone? Would this impact steam fairs and car shows? There's also a government survey here, overly complex, a simple yes or no would suffice.
